The Fatigued Truck Driver Causing The Accident

We have found that fatigued truck drivers causes the vast majority of our trucking cases in California and nationwide. There are strenuous federal regulations concerning fatigued driving limiting the hours of the day that a truck driver can actually drive. In every truck driving case, we investigate whether or not the driver was fatigued. We research and make certain we obtain the driver's logbook which is supposed to inform us the amount of hours he has been working. Unfortunately, oftentimes logbooks are faked and there are really two sets of logbooks. We can tell when there are false entries.

We do this by immediately sending out what's called a "Spoilation of Evidence" letter to the trucker and the company to obtain the logbook and make certain they do not destroy or alter the logbook or any other evidence which would show that the driver was likely to be fatigued when the accident occurred. We move to immediately locate all evidence. We are always looking at fatigue as being the cause or major contributing factor of the crash. We are also looking for equipment violations. We look to the truck driver's qualifications to make certain that he does not have a false employment history, any negative medical information, or a criminal record which would affect his driving. If the insurance company for the trucking company lies to us about the amount of insurance coverage, we can then build a punitive damages case against the truck driving company's insurance company. Unfortunately, there is a lack of honesty in this industry and it happens often.
